(1) A person shall have the right to be admitted and registered as a lawyer if: – The Council of Legal Practice is a national statutory body established under Article 4 of the Law No 28 of 2014 on the Practice of Law. The Council of Legal Practice and its provincial councils regulate matters and exercise jurisdiction over all legal practitioners (lawyers and lawyers) and trainee lawyers. (b) A lawyer referred to in clause (a)(ii) may provide legal services provided by lawyers before the coming into force of this Act only to the extent determined by the Council in the Rules of Procedure if he: (a) constitutional practice; (b) legal ethics in the profession; (c) claims for bodily injury; (d) the practice of the Supreme Court; (e) the practice of the Magistrate`s Court; (f) the practice of criminal courts; (g) the settlement of labour disputes; (h) out-of-court dispute resolution (i) lawyers` accounting; (j) wills and estates; (k) matrimonial law; (l) court costs; (m) drafting of contracts; (n) information and communication technologies for the practice and related aspects of cyberlaw; and (o) Introduction to practice management. 7. The provision of a trainee lawyer to a lawyer as long as he is not practising or has not practised within the meaning of paragraph 5 shall not be regarded as a service under a practical professional training contract within the meaning of those provisions. 8. A lawyer referred to in points (a) to (e) of paragraph 5 may at no time have more than three trainee lawyers and a lawyer referred to in point (f) of paragraph 5 shall not employ or retain at any time more than six trainee lawyers under a practical training contract. (9) If a lawyer dies or retires from the practice or has been removed from the list, one of his surviving or remaining partners, any member of the legal business entity to which he belonged, or any other lawyer employed full-time by Legal Aid South Africa or the relevant institution, may assign the trainee`s practical professional training contract, Despite the fact that: that the assignee may then have more than three or six trainee lawyers under contract. (10) The programme of structured courses referred to in subparagraphs (a) and (b) of paragraph 1 shall be unified and uniform throughout the Republic and shall comprise the following modules: (7) A legal business entity may be established to operate a law firm provided that, with respect to its governing documents: (aa) the majority of its members of its governing body are legal practitioners; and (c) has met all practical training requirements for trainee lawyers prescribed by the Minister, including, (1) A person may practise as a lawyer only if the person is admitted and registered as such within the meaning of this Act.

(i) a non-profit legal person registered under the Not-for-Profit Corporations Act, 1997 (Act No. 71 of 1997) to run a law firm where, in relation to their governing documents, lawyers (called baristers in England) form the „bar“ and are commonly referred to as „advocates“. They specialize in preparing court proceedings, appearing before courts and other tribunals, and preparing legal opinions. In 2018, there were 5396 practising lawyers in South Africa. Since the advent of the LPC, lawyers can now be informed directly by the public, provided they have taken a course in practice management and have an escrow account. Lawyers (called solicitors in the UK) form the „sidebar“ and are commonly referred to as „lawyers“. Lawyers are the general legal practitioners and perform all kinds of legal work. They handle legal matters, deal directly with their clients and work as sole proprietors or in small, medium or large businesses. In 2018, there were 24290 practising lawyers in South Africa.

The Legal Practice Council is the oversight body for the legal profession in South Africa.

The Legal Education and Development Division (LEAD) of the Law Society of South Africa has been accredited by the Legal Practice Council to provide practice management training to meet this requirement. (4) An advocate who is removed from the list or suspended from the practice of the profession shall not, (i) be in possession of a certificate from the Loyalty Fund and practise in accordance with the relevant provisions of Chapter 7, including by reference to sections 84, 85, 86 and 87; Requirements for practical professional development that trainee lawyers must meet before they can be admitted to the bar by the court 6. (1) A person who intends to be admitted and registered as a lawyer shall, after meeting all the requirements for obtaining a degree in accordance with section 26 (1) letters a or (b) of the Act, serve under a contract of practical professional training with a person referred to in subsection (5) – (i) may provide legal services only if those services are provided by or under the supervision of lawyers; With respect to the Law Practice Act 2014, lawyers fall under the regulatory and disciplinary jurisdiction of the Provincial Bar Council in which they practice.
