Prostitution in Cuba has always been a legal profession, although it has been regularly regulated or repressed. The UNODC report highlights that more victims are being detected worldwide, including in some Latin American countries, but that there is still a risk in the region that prostitution will increase due to the vulnerability of situations such as the migration crisis and armed conflict, which promote both trafficking in human beings for the purpose of sexual exploitation and those who consider prostitution as the only means of to earn a living. Prostitution between adults is legal for women and men over the age of 18 if they register with the municipal authorities and have a health certificate with them.

Police officers tolerate the operation of brothels without a licence.  Although there is no red light district in the capital Asunción, street prostitution is widespread in the city center, particularly around Plaza Uruguaya. Prostitution is illegal under the Sexual Offences Act 1986 and the Summary Offences Act 1921.
